Conditions of participation in the Instagram competition (including data protection information)

The competition is not affiliated with Instagram and is in no way sponsored, supported or organized by Instagram. By participating in the competition, Instagram is released from any liability arising from claims in connection with the implementation of the competition (in particular its publication and organization).
The specified organizer is the sole contact person and responsible person.
If only the male form of language is used in these terms and conditions, this is only for linguistic simplification.

We are giving away the following prize among all submissions / likes / reposts / comments / story posts / direct messages:
A voucher code for the webshop www.makimo.de worth €50 (in words: FIFTY EURO). The voucher code can be redeemed until November 30, 2023 at 11:59 p.m. (CEST).
The participation period is from October 26th, 2023 to October 31st, 2023 at 11:59 p.m. (CEST).
To take part in the raffle, you must follow our account on Instagram at the URL https://instagram.com/makimo.shop by October 31, 2023 at 11:59 p.m. (CEST), like the competition post, leave a comment under it and be allowed to do so Additionally (voluntarily) mark a contact under the post.
The prerequisite for participation in the competition is that the participant is a consumer within the meaning of Section 13 of the German Civil Code (BGB) and has reached the age of 18.
We reserve the right to exclude a participant from the competition, especially if they provide false information, carry out other manipulations or use unauthorized tools.
The winner will be determined through the following process:
Winners will be determined by random drawing from all valid entries.
Only entries submitted within the participation period will be taken into account when determining the winner.
We reserve the right to change, cancel or prematurely end the competition at any time without notice due to unforeseen circumstances, without the participant incurring any claims against the organizer.

The prize will be sent to the winner after prior notification of the email address.
Participants are responsible for the accuracy of the contact details provided.
If the prize is undeliverable, no further inquiries will be made about the participant. If the winner does not respond within 5 days of sending the prize notification, the claim to the prize will expire.
When the prize is sent, the risk of deterioration and accidental loss passes to the winner.
A payout of the monetary value of the prize or the exchange of the prize are excluded. The prize is not transferable.
Legal recourse is excluded.
The exclusively applicable law is the law of the Federal Republic of Germany.
The ineffectiveness of individual provisions of the conditions of participation does not affect the effectiveness of the remaining conditions.
Data protection information:
1. Processing of personal data
By participating in our competition, we will only collect your personal data (name, contact details and email address) to the extent provided by you. The data processing serves the purpose of properly conducting the competition and to notify you if you win.
This data processing is carried out on the basis of Article 6 Paragraph 1 Letter a GDPR with your consent. You can revoke your consent at any time by notifying us without affecting the lawfulness of the processing carried out based on your consent before its revocation. Your data will then be deleted.
A transfer of data to third parties does not take place.
If you win, you agree to the publication of your profile name or first and last name under which you took part in the competition on Instagram. The purpose of the publication is to announce the winner of the competition. This data processing is carried out on the basis of Article 6 Paragraph 1 Letter a GDPR with your consent. You can revoke your consent at any time by sending us a message. Your data will then be deleted.
2. Storage period
We store your personal data for as long as this is necessary for the decision on the competition. Your data will then be deleted after three months at the latest, unless you have consented to further processing and use and/or we have no legitimate interest in storing it.
3. Rights of those affected
If the legal requirements are met, you are entitled to the following rights in accordance with Articles 15 to 20 of the GDPR: right to information, to correction, to deletion, to restriction of processing, to data portability. In addition, according to Art. 21 Para. 1 GDPR, you have the right to object to processing based on Art. 6 Para. 1 f GDPR, as well as to processing for the purpose of direct advertising.
Right to lodge a complaint with the supervisory authority
According to Art. 77 GDPR, you have the right to complain to the supervisory authority if you believe that your personal data is not being processed lawfully.

If the personal data processing listed here is based on our legitimate interest in accordance with Article 6 Paragraph 1 Letter f of the GDPR, you have the right to object to this processing at any time with future effect for reasons arising from your particular situation.
After an objection has been made, the processing of the data concerned will be terminated unless we can demonstrate compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.
